Brazil electoral law restricts flag use in political campaigning

Under Brazilian electoral law, the use of flags for political campaigning is permitted only if they remain mobile. According to legal guidelines for the 2026 elections, fixing flags to concrete or cement bases on public streets is considered irregular propaganda.

Lawyer Gilmar Cardoso explains that flags must serve as dynamic and temporary instruments of political manifestation. While militants may hold flags or use mobile bases during the day, the law prohibits structures that are immobilized or arranged in a contiguous manner that creates a static visual wall. Such arrangements are treated as illegal billboards by the Superior Electoral Court.

Other permitted forms of campaigning include parades, rallies, and internet promotion, provided they follow established rules. All printed campaign materials must include the campaign's CNPJ number, the printer's identification, and the print run details. Additionally, stickers on vehicles or windows are restricted to a maximum size of 0.5 m².
