Brazil Enacts Pix Pensão Law for Automatic Child Support Payments

President Luiz Inácio Lula da Silva signed Law No. 15.479, known as the “Pix Pensão” law, which will take effect in July 2027. The legislation amends the Brazilian Code of Civil Procedure to allow courts to order the automatic transfer of monthly child‑support payments via the Pix system directly from the debtor’s bank account to the beneficiary’s account. Once a judicial decision or a homologated agreement is in place, the creditor or a legal representative may request the automatic payment, providing the necessary bank details and Pix key. The judge then issues an electronic order, and the bank debits the payer on the set date and credits the recipient without further authorisation from the payer. The transfer cannot be cancelled or altered without a new court order; insufficient funds may be covered by other accounts of the debtor up to the amount due. Lula highlighted the law’s role in strengthening enforcement, noting that non‑compliant debtors could be fitted with electronic ankle bracelets to protect women and children. The measure aims to reduce arrears and improve compliance with child‑support obligations across Brazil.
