Legal protections have also been bolstered by the Superior Tribunal de Justiça (STJ). The STJ’s Third Chamber unanimously overturned a decision by the Santa Catarina Court of Justice, ruling that judges may include provisions in alimony sentences to establish specific payment amounts based on a percentage of the minimum wage during unemployment or informal work. Minister Nancy Andrighi clarified that such provisions are decisions of “variable efficacy” rather than decisions conditioned on uncertain events, ensuring support remains effective regardless of the debtor’s professional status.
