Under Brazil's Traffic Code, a driver who drives through a water puddle and sprays a pedestrian can be cited for a medium‑level violation (article 171). The penalty is a fine of R$ 130.16 and four points on the driver's licence.

A separate offense is overtaking another vehicle by using the highway shoulder. This action is classified as a gravíssima violation (article 202) and incurs a fine of R$ 1,467.35 plus seven licence points. Both infractions aim to protect pedestrians, emergency vehicles and road safety.
