Brazil legislative proposal seeks amnesty for 10 years of speeding fines

A substitute bill presented in the Brazilian Chamber of Deputies proposes an amnesty for speeding fines recorded by speed radars over the last ten years. Authored by Federal Deputy Cezinha de Madureira (PL-SP), the proposal modifies Bill 3,516/2019.

The text seeks to cancel penalties from all types of speed measurement equipment and remove associated interest, monetary correction, and other charges. Unlike the original version of the bill, which aimed to prohibit the use of static, mobile, or portable speed meters, this substitute maintains electronic surveillance while expanding the scope of the amnesty.

If approved, transit agencies at federal, state, district, and municipal levels would have six months to clear the amnesty-eligible fines from both vehicle records and driver files. The proposal also allows the Executive Branch to conduct a comprehensive review of speed enforcement equipment, including calibration, metrological verification, and digital certification audits. Madureira argues the measure is necessary to ensure administrative justice and legal security, citing potential flaws in previous calibration and measurement procedures.
