Brazil PT files legal challenges over AI deepfake of Jair Bolsonaro

The Federation Brazil of Hope, comprising the PT, PV and PCdoB, filed parallel actions in the Tribunal Superior Eleitoral (TSE) and the Supreme Federal Court (STF) after a 46‑second artificial‑intelligence (AI) deepfake video was shown at the Liberal Party (PL) convention on 25 July 2026. The video recreated former President Jair Bolsonaro’s image and voice to endorse his son, Senator Flávio Bolsonaro, as the PL presidential candidate.

The PT alleges that the video amounts to premature electoral propaganda and illegal use of AI, violating Brazil’s electoral resolution 23.610/2019 (as amended) which bans synthetic content that can influence voters. The party seeks an immediate removal of the video from all platforms, a fine of R$ 30,000 on the PL and on Flávio Bolsonaro, and, in the STF filing, claims the video breaches precautionary measures imposed on Jair Bolsonaro by Minister Alexandre de Moraes, which prohibit the ex‑president from making political statements while under house arrest.

The STF has not yet ruled on the alleged breach, and the TSE is still evaluating whether the deepfake contravenes election law. Legal experts consulted by various outlets concur that the content likely violates the prohibition on deepfakes, though some note that the video was labeled as AI‑generated at the start of the broadcast. The case has sparked a broader debate on the use of synthetic media in Brazil’s 2026 elections.
