Brazil Labour Party files suit over AI Bolsonaro video backing Flávio FAST-MOVING

The Federação Brasil da Esperança – a coalition of the Labour Party (PT), PV and PCdoB – lodged actions with Brazil's Superior Electoral Court (TSE) and the Supreme Federal Court (STF) challenging a deep‑fake video of former President Jair Bolsonaro that was shown at the Liberal Party (PL) national convention on 25 July 2026. The 46‑second AI‑generated clip recreates Bolsonaro’s image and voice to endorse his son, Senator Flávio Bolsonaro, as the party’s presidential candidate.

The parties argue that the video constitutes premature electoral propaganda, violates the TSE’s 2024 resolution prohibiting synthetic audiovisual content (deepfakes) in campaigns, and breaches a court order that bars Jair Bolsonaro from any political statements while he serves a house‑arrest sentence. They request a fine of R$ 30,000 against the PL and Flávio’s campaign, and the immediate removal of the video from all online platforms. The case also raises the question of whether a disclaimer that the material is AI‑generated can exempt it from the ban.

Legal experts cited confirm that the electoral resolution 23.610/2019 expressly forbids the use of digitally altered or generated content to influence elections, regardless of labeling. The PT’s filing also includes a factual notice to Supreme Court minister Alexandre de Moraes alleging a breach of the precautionary measures imposed on Bolsonaro.
