Brazil revises Rural Credit Manual, easing loan extensions for farmers

Resolution No. 5.314/2026, issued by Brazil's Conselho Monetário Nacional, took effect on 1 July 2026 and amends the Manual de Crédito Rural. The amendment expands banks' administrative discretion to grant extensions of rural credit operations, provided the borrower submits a request and demonstrates temporary payment difficulty, such as harvest shortfalls, marketing problems or climate‑related cash‑flow issues.

The change does not alter the legal rights of producers. As lawyer Frederico Buss of HBS Advogados notes, “a resolução promove um ajuste no procedimento administrativo de análise dos pedidos de prorrogação, mas não afasta os direitos previstos na legislação do crédito rural.” Any approved extension must be formalised through an amendment to the original contract, preserving the original financial terms and without additional interest, fines or substitution by costlier loan products. The new rules apply only to contracts signed from 1 July 2026 onward, and producers are advised to request extensions before the due date and retain documentation of the request.
