Brazil's CNJ imposes judicial licences for child influencers on social media
On 23 June 2026 the Conselho Nacional de Justiça (CNJ) approved a resolution that makes a judicial authorisation – an alvará – mandatory for children and adolescents to create or appear in digital content on platforms such as TikTok, Instagram and Facebook. The alvará must be requested individually, its validity limited to 12 months for children and 18 months for adolescents and may be revised at any time. Judges must assess criteria including the minor’s age, health, school attendance, exposure frequency, hours of activity and the financial handling of any earnings. The rule also creates a Banco Nacional de Alvarás (BNAD) to record all authorisations and support public‑policy monitoring. Prohibited content includes erotic or sexual material, abusive child advertising, gambling, hate speech, discrimination, and any form of work that amounts to child labour. The measure implements the Estatuto da Criança e do Adolescente (ECA) Digital and aims to protect minors from economic exploitation and excessive exposure online.
The CNJ stressed that the alvará does not permit advertising by minors; it is solely a tool to monitor artistic‑type activities while ensuring the child’s development and safety.
