Brazil Supreme Court expands vehicle tax exemption to all autistic and disabled persons

The Supreme Federal Court (STF) ruled unanimously that the restriction in Law Complementary 214/2025, which limited the zero‑rate tax exemption for vehicle purchases to people with moderate or severe disability and excluded autistic individuals at level 1 and those with light disability, is unconstitutional. Relator Minister Alexandre de Moraes said the Constitution does not differentiate between degrees of disability, and the court struck down the clauses in ADI 7779 and ADI 7790.

The decision extends the exemption of the Imposto sobre Bens e Serviços (IBS) and the Contribuição sobre Bens e Serviços (CBS) to all persons with disability (PCD) and to people with autism spectrum disorder, regardless of severity. The three‑year interval between successive exemptions and other procedural rules remain unchanged. While the ruling reduces government tax revenue, it does not harm the automotive industry, which may see increased demand.

Separate legislative proposals are under discussion to raise the IPI exemption ceiling for PCDs to R$ 250 000, but those bills are still pending in Congress.
