Brazil Supreme Court Issues Rulings on Sentencing Law and Online Platform Liability

The Brazilian Attorney General, Paulo Gonet, urged the Supreme Federal Court (STF) not to suspend the Lei da Dosimetria pending a final decision, arguing there is no justification to halt the law’s effects and that legislative matters should remain with Congress until the Court reaches a definitive ruling.

Separately, the STF approved a final wording of its thesis on digital platforms, expanding the entities’ responsibility for user‑posted content. The amendment clarifies that platforms can be held liable if they fail to promptly remove material related to serious crimes such as terrorism, coup attempts, racism, homophobia, and offenses against women and children. The decision takes immediate effect and will guide lower courts nationwide, pending future congressional legislation on platform duties.
