Brazil tightens platform liability, election safeguards

Overview

Since late May 2026, President Lula has expanded ANPD powers and imposed a two-hour removal duty on large platforms for illegal content. The Supreme Federal Court affirmed a broad duty of care, granting a 60-day transition period. In preparation for the October elections, the Superior Electoral Court (TSE) has implemented aggressive disinformation safeguards. On 28 July, the TSE issued Portaria No. 463/2026, requiring platforms with over five million monthly users to submit compliance plans by 16 August regarding content removal, AI safeguards, and transparency. To bolster public confidence, the TSE held the first National Week of the Electronic Voting System (3–9 August), featuring a live broadcast where technical teams demonstrated security layers and cryptographic safeguards. During this period, the TSE also held a ceremony to digitally sign and seal the voting software, making the programs immutable. Information Technology secretary Júlio Valente stated, “Nesse momento, os sistemas estão encerrados, são finalizados, nada mais pode mudar.”

In late August, the TSE intensified oversight of digital platforms and party finances. Starting 31 August, the TSE began a virtual judgment to review the registrations of 13 presidential candidates.

By early September, regional electoral courts expanded digital engagement and security efforts. In Piauí, the TRE-PI launched ‘Kiwi’, a WhatsApp tool for checking polling station queues, alongside the ‘Eleições+’ app to combat disinformation. In Minas Gerais, the TRE-MG affirmed there is ‘zero possibility of fraud’ in the electronic system, emphasizing that AI-generated propaganda must be clearly identified. Meanwhile, the TRE-AL issued clarifications to combat misinformation, noting that blank and null votes are not transferred to candidates and asserting that printed ballots are unnecessary due to existing electronic protections. Regional courts also noted that platforms may temporarily restrict certain functionalities, such as donation forms, to ensure compliance with electoral impartiality laws.
