Flávio Bolsonaro defense challenges Moraes and seeks case transfer

The legal defense for Senator Flávio Bolsonaro has filed petitions with the Brazilian Supreme Federal Court (STF) to revoke judicial orders and remove Minister Alexandre de Moraes as the rapporteur of an ongoing investigation. The investigation examines suspected money laundering involving foreign betting platforms and companies linked to lawyer Willer Tomaz.

Defense attorneys are requesting that the case be transferred to Minister André Mendonça, arguing that Mendonça is already overseeing related investigations involving Tomaz through Operation Sem Desconto. The defense also seeks to overturn several precautionary measures, including the seizure of Bolsonaro’s passports and a prohibition on contacting Tomaz. These requests follow reports that Bolsonaro left Brazil for the United States via Argentina and Ecuador, reportedly using an Italian passport.

Furthermore, the defense has requested that Minister Moraes be declared impeded or suspect. They allege a conflict of interest involving a connection between an aircraft company used in a January 2025 trip and the law firm of Moraes’ wife, Viviane Barci de Moraes. While the defense contests the legality of the restrictions, STF President Edson Fachin is expected to maintain the current distribution of the inquiry and the role of Minister Moraes.
