Brazil tax authorities tighten oversight on PIS, Cofins, and CBS credits
The Brazilian Federal Revenue Service (Receita Federal) is implementing several measures regarding tax credits and compliance. Companies have until November 10, 2026, to voluntarily regularize potential inconsistencies in PIS/Pasep and Cofins credits, following the identification of R$ 1.3 billion in possible discrepancies.
Regarding the new Contribution on Goods and Services (CBS), the Receita Federal plans to release integration tools in late 2026 to help businesses verify debits and credits, aiming to prevent errors in tax documentation that could lead to rejected invoices or lost credits.
In a significant ruling, the Receita Federal has determined that self-generated electricity does not grant the right to PIS and Cofins tax credits, as the energy is produced for internal consumption rather than being acquired from third parties. This decision impacts companies investing in distributed generation, such as solar power.
Concurrently, Aneel projects an average electricity tariff increase of 9.4% in Brazil for 2026, exceeding inflation. This rising cost is driving increased interest in solar energy as a means to achieve budgetary predictability and reduce operational expenses.
