Brazil advances technical rules for CBS and IBS tax reform

Brazil is advancing the technical implementation of its tax reform, which will replace several existing taxes with a Dual Value Added Tax (VAT) consisting of the federal CBS and the state/municipal IBS.

The Receita Federal and the CGIBS have formalized new technical specifications for electronic tax documents. This includes updates for NF-e, NFC-e, and BP-e, as well as the creation of the NF-e ABI (model 77) specifically for real estate alienation. These changes aim to standardize information and facilitate the calculation of the new taxes.

As the transition approaches, uncertainty remains regarding the final tax rates. The Receita Federal is expected to present the CBS rate proposal to the TCU by September 14, with the Senate required to set a reference rate by October 30. Estimates suggest the total VAT rate could reach 27.91%, potentially making it one of the highest in the world. The new system is scheduled to begin in January 2027, with a full transition expected by 2033.
