Brazil traffic rules for intersections with failed signals
When traffic lights fail or operate in warning mode, intersections are legally treated as locations without traffic light control under the Brazilian Traffic Code (CTB). In these scenarios, drivers must first observe vertical signaling, such as traffic signs, which remain valid even if the lights are off.
According to Article 29 of the CTB, if there is no specific signage or ground markings to regulate priority, the following rules apply to determine the right of way:
• Vehicles traveling on a highway have priority at intersections involving a highway. • Vehicles already circulating in a roundabout have priority. • In all other cases, priority is given to the vehicle approaching from the driver's right.
It is a common misconception that traveling on a wider or busier road grants automatic priority; the CTB does not use road width or traffic volume to define precedence. Additionally, an intermittent yellow light serves only as a warning and does not grant priority to any direction, requiring drivers to reduce speed and proceed only when safe.
