Brazilian Bar Association joins STF case on public‑servant salary floors
The National Council of the Brazilian Bar Association (OAB) voted unanimously on 15 June in João Pessoa to join the Supreme Federal Court (STF) as amicus curiae in Extraordinary Appeal RE 1416266. The case examines whether states and municipalities must respect federal salary‑floor laws for statutory public servants in regulated professions, a matter granted general repercussion (Tema 1250) by the Court.
The OAB aims to provide technical input on the constitutional balance between the Union’s authority to regulate professions and sub‑national autonomy, arguing that a uniform national standard protects thousands of public‑servant workers and maintains legal certainty. Council member Ian Cavalcante stressed the need to harmonise federal competence with the federative pact, preserving fiscal responsibility and juridical security. The Court’s ruling will set a nationwide precedent for salary‑floor application across regulated professional categories.
