Bolsonaro coup trial and related legal appeals
Overview
The Supreme Federal Court (STF) has resumed hearings in the coup-attempt trial of former President Jair Bolsonaro and seven allies regarding an alleged attempt to execute a coup d’état following the 2022 elections. Recent proceedings include scheduled testimony from ten defense witnesses for General Augusto Heleno, including former Health Minister Marcelo Queiroga and GSI executive secretary Carlos Penteado. Queiroga is also expected to testify for former Defense Minister Walter Braga Netto.
New developments indicate that the court is also set to hear testimony from former Justice Minister Anderson Torres and Jair Bolsonaro himself. The hearing process is expected to conclude by June 2, followed by a 15-day period for final arguments before the rapporteur schedules defendant interrogations.
Bolsonaro is currently serving a sentence of 27 years and 3 months for his involvement in an attempted coup d'état between 2022 and 2023, and is presently under humanitarian house arrest for health reasons. In a recent virtual trial, the STF's First Chamber formed a majority to reject a habeas corpus petition seeking his release. The petition, filed by third party Claudio Leme Cavalheiro without the authorization of Bolsonaro or his legal team, was rejected by Justices Cármen Lúcia and Cristiano Zanin. Justice Alexandre de Moraes recused himself from the proceedings as the authority being questioned in the criminal execution process. The final vote from Justice Flávio Dino remains pending.
In related legal developments, the STF has scheduled high-profile judgments for September. Between September 11 and 18, the First Chamber will review an appeal filed by the Public Defender's Office (DPU) regarding the sentence of former federal deputy Eduardo Bolsonaro.
