Brazilian Condominium Law Enables Virtual Assemblies and Shifts Debt to Owners
Law No. 14.309/2022 amended Brazil's Civil Code to permanently permit electronic condominium meetings, allowing fully virtual or hybrid formats. The legislation requires clear notice of the meeting mode, the platform to be used, and guarantees that participants can view debates, make statements and vote. Platforms must identify attendees and securely record votes, with recordings and attendance lists kept for verification.
In a separate case, the 10th Civil Chamber of the Tribunal de Justiça do Paraná applied the precedent of the Superior Tribunal de Justiça to redirect a condominium's unpaid debt of R$ 204,415.62 to its owners. Citing article 1.315 of the Civil Code, the court ruled that when a condominium lacks assets, owners can be held liable proportionally for the debt, even without their participation in the execution process.
