Brazilian courts issue rulings on civil liability and damages

The Court of Justice of Santa Catarina (TJSC) has upheld a ruling condemning service providers to pay damages following a physical altercation during a truck removal operation. The incident, which occurred in February 2023, involved a dispute between a truck owner and a removal team regarding procedures. During the conflict, a service provider kicked the owner in the face, resulting in a fractured jaw, tooth loss, and other injuries.

The court rejected claims of self-defense, noting that while verbal provocations occurred, the physical response was disproportionate and unjustified. The ruling includes compensation for medical expenses, dental implants, and moral damages.

In a separate legal matter, the Court of Justice of Rondônia (TJRO) ordered Detran/RO to indemnify a driver whose vehicle was destroyed while stored in a public impound lot. The court ruled that the agency failed to protect the vehicle from the elements, leading to its total deterioration. The decision mandates the payment of the vehicle's full value and the cancellation of all taxes and fees accrued during the period of seizure.
