Brazilian judicial rulings on civil liability

Overview

Brazilian courts have issued several rulings regarding civil liability and the responsibility of service providers to indemnify for damages.

The Superior Tribunal de Justiça (STJ) ruled that subcontracted road transporters bear objective liability for cargo damages. Under this decision, a subcontractor is directly responsible to the primary carrier for any losses, thefts, or damages that occur during the execution of services.

In other regional cases, the Court of Justice of Santa Catarina (TJSC) upheld a ruling for damages following a physical altercation during a truck removal operation, where a service provider’s disproportionate response to a dispute resulted in significant injuries to a truck owner.
