Brazilian courts regulate children's digital artistic and commercial exposure

The Court of Justice of Santa Catarina (TJSC) has issued new guidelines regarding the necessity of judicial authorization for children and adolescents participating in artistic activities online. Following Resolution 687/2026 of the National Council of Justice (CNJ), judicial permits are required when artistic content is monetized or promoted in a way that habitually exploits the image or routine of a minor.

In a related legal development, the Childhood and Youth Court of Itajaí rejected a request for continuous commercial exposure of two children on their mother's social media profiles. The court ruled that parental authority does not grant unrestricted rights to use a child's image for economic purposes. The judge emphasized that permissions must be analyzed individually based on the best interests of the minor, noting that generic authorizations for habitual participation in advertising and commercial partnerships are not permitted under the Statute of the Child and Adolescent (ECA).
