Brazil's next president could appoint four STF ministers

The next Brazilian presidency will hold the power to reshape the Supreme Federal Court (STF), with at least four ministerial appointments expected. Vacancies are anticipated for ministers Luiz Fux, Cármen Lúcia, and Gilmar Mendes, alongside the currently open seat held by Luís Roberto Barroso.

The political landscape for these appointments has shifted following recent elections and a rightward turn in the Senate. A potential Flávio Bolsonaro presidency could lead to appointments aligned with bolsonarismo, including figures like TCU Minister Jorge Oliveira. Conversely, a re-election of Lula may face significant hurdles in the Senate, where the Liberal Party (PL) holds the largest caucus, making the approval of his preferred candidates more difficult.

Beyond appointments, newly elected senators are prioritizing judicial reform and the potential impeachment of STF ministers. Several lawmakers have advocated for impeachment proceedings, which require 54 Senate votes, while new appointments require 41. Proposals such as PEC 16/2019, which suggests eight-year fixed terms for ministers, are also central to the upcoming legislative agenda.
