Brazil sues Discord for $97 million over child safety failures
The Brazilian government has filed a lawsuit against the messaging platform Discord, seeking 500 million reais (approximately $97 million) in damages for collective moral harm. The legal action, brought by the Attorney General of the Union (AGU), follows a tragic incident in July where a 13-year-old girl committed suicide during a live broadcast on the platform.
Authorities allege that Discord has failed to implement adequate safety mechanisms, including insufficient age verification and inadequate protection for vulnerable groups such as children, adolescents, and women. The lawsuit also highlights failures in moderating content, describing certain digital environments on the platform as 'digital cracklands' and 'digital safaris' where violence and illegal behaviors are permitted.
In addition to financial compensation, the government is demanding structural changes. These include the implementation of stricter parental controls, enhanced cooperation with local law enforcement, and the deployment of automated tools to detect and remove dangerous content. The São Paulo Public Prosecutor's Office has also initiated a structural civil action to force a reorganization of the company's governance and safety protocols.
Discord has responded by calling the legal action 'disproportionate,' stating that it remains committed to safety and has maintained a dialogue with Brazilian authorities. The platform previously agreed to suspend livestreaming features in Brazil following pressure from the National Data Protection Agency (ANPD).
