Brazil's ANP fines fuel distributors over R$ 700 million

The Brazilian National Agency of Petroleum, Natural Gas and Biofuels (ANP) has issued over R$ 700 million in fines to nine fuel distributors for abusive price increases. These penalties stem from ten administrative processes following inspections conducted during the period of provisional measures intended to mitigate price escalations caused by conflicts in the Middle East.

While these fines represent first-instance decisions that companies may still appeal, regulatory scrutiny is intensifying. The National Consumer Secretariat (Senacon) has launched an operation to investigate potential profit margin abuses at gas stations following approximately 330 complaints of unjustified price hikes. Senacon has initiated 70 administrative sanctioning processes as part of this effort.

In a separate legal development regarding fuel pricing, a judge in São Luís, Maranhão, rejected a lawsuit against seven retailers accused of cartelization and abusive pricing. The court ruled that in a free-market system, similar pricing between neighboring stations does not constitute proof of a cartel without comprehensive forensic accounting, noting that pricing is influenced by freight, taxes, and replacement costs.
