Brazil maintains diesel subsidy and increases fuel sector inspections

The Brazilian government has announced a series of measures to combat rising fuel prices, driven by international oil volatility and conflicts in the Middle East. A central component of this strategy is the maintenance of a diesel subsidy of R$ 2.12 per liter, as confirmed by the Ministry of Finance through Ordinance No. 2,946/2026.

To prevent abusive pricing, the government is intensifying inspections through 'Operação Carga Pesada,' a task force involving the National Petroleum Agency (ANP), Senacon, and various Procons. Between September 21 and 25, the operation conducted 241 inspection actions. Additionally, Senacon has opened 70 administrative sanctioning processes against distributors and gas stations.

New legislative measures, including Provisional Measure No. 1,393, have updated the Consumer Defense Code to establish specific fines for fuel sector infractions. These penalties can range from R$ 20,000 to R$ 500 million for conduct such as unjustified price increases. The ANP has already determined fines exceeding R$ 700 million against distributors for previous instances of abusive pricing.
