PGR opposes access to Senate entry records of public figures

The Prosecutor General of the Republic, Paulo Gonet, has submitted an opinion to the Supreme Federal Court (STF) opposing a request to release Senate entry and exit records for several individuals. The legal action, a writ of mandamus filed by Curitiba councilman Guilherme Kilter (Novo), seeks access to logs involving Daniel Vorcaro, former controller of Banco Master; Viviane Barci de Moraes, wife of Supreme Court Justice Alexandre de Moraes; and Fábio Luís Lula da Silva, son of President Luiz Inácio Lula da Silva, among others.

The Senate had previously denied the request, citing the protection of personal data. In his opinion, Gonet argued that the legal instrument used by Kilter is inappropriate, as Supreme Court jurisprudence dictates that a writ of mandamus filed in one's own name cannot be used to defend collective rights. He stated that the petitioner failed to prove a violation of a specific, liquid, and certain subjective right.

The case is currently being reported by Justice Luiz Fux, who previously noted that Alexandre de Moraes had declared himself impeded from participating in the matter.
