Brazil Supreme Court dismisses Moraes family's lawsuit against Senator Vieira

The São Paulo court rejected a moral‑damage claim filed by the wife and children of Supreme Court Justice Alexandre de Moraes against Senator Alessandro Vieira. Judge Fabio de Souza Pimenta ruled that Vieira’s remarks in a televised interview were covered by parliamentary immunity and did not constitute a direct accusation that the minister’s relatives received funds from the Primeiro Comando da Capital (PCC). The family had sought R$ 60 000 in compensation, alleging defamation over statements that the Banco Master had moved money linked to the criminal organization. Similar decisions were reached by other courts, concluding that the senator’s comments could not be interpreted as a factual link to the PCC and therefore were not actionable.

The case originated from Vieira’s interview about investigations into financial flows involving Banco Master, which he cited without attributing illicit payments to the minister’s family. All rulings emphasized the protection of parliamentary speech and dismissed the claim as unfounded.
