Brazil Electoral Courts ban use of Bolsonaro's image in campaigns
Brazilian electoral courts have issued several rulings prohibiting candidates from using former President Jair Bolsonaro's image in campaign materials. These decisions aim to prevent candidates from bypassing Supreme Federal Court (STF) restrictions that prohibit Bolsonaro from disseminating political-electoral manifestos, even through third parties.
In São Paulo, the Superior Electoral Court (TSE) prohibited candidate Lucas Bove from using 50,000 leaflets and wind banners that featured Bolsonaro's image prominently alongside Bove's name and number. In the Federal District, the Regional Electoral Court (TRE-DF) suspended campaign advertisements for Michelle Bolsonaro that used images of her husband and attributed a “mission” to him, imposing a daily fine of R$ 5,000 for non-compliance. Additionally, in Paraná, the TRE-PR ordered candidate Sandro Alex to remove materials that associated him with Bolsonaro to avoid creating a false impression of a current electoral alliance.
These rulings collectively reinforce the legal interpretation that using Bolsonaro's likeness to suggest political support constitutes a violation of existing judicial restrictions on his electoral activities.
