Brazilian electoral courts intensify digital oversight

Since the October 2026 TSE order, Brazil’s electoral judiciary has broadened its digital monitoring and enforcement. The Mato Grosso Regional Electoral Court (TRE‑MT) upheld a 24‑hour takedown order against pre‑candidate Antero Paes de Barros and later rejected an injunction to ban the nickname “Mauro Master,” deeming it satirical. The court also suspended a prior order to delete posts by Mauro Mendes and Otaviano Pivetta, finding no early‑campaign violation, while fining Senator Wellington Fagundes for explicit vote solicitation.
State tribunals have continued to nullify or uphold mandates for electoral abuse: the Paraná TRE stripped a council seat in Curitiba for gender‑quota fraud; the Maranhão TRE removed the mayor and vice‑mayor of São João Batista; the Alagoas TRE reviewed removal of Piaçabuçu officials; and the Sergipe TRE cancelled the mandates of Simão Dias’s mayor and vice‑mayor. Gender‑quota violations also prompted a São Paulo TRE ruling against the Mobiliza party and a national debate in the TSE on limiting annulments to benefitting male candidates.
The courts have targeted online misinformation and hate speech. The Amazonas TRE ordered the deletion of early‑campaign propaganda by former mayor David Almeida. The Rio de Janeiro TRE created a Digital Propaganda and Disinformation Unit to monitor fake news, deepfakes and AI‑generated content. In Paraná, a judge ordered Sergio Moro’s team to remove an AI‑generated video, citing TSE resolutions on AI disclosure.
Beyond electoral bodies, the Supreme Federal Court upheld a constitutional 30 % funding quota for Black candidates, while the Federal Public Ministry pursued fines against a poll institute for falsified financing data. Together, these actions illustrate an expanding judicial framework aimed at curbing illegal propaganda, enforcing gender and racial equity, and safeguarding the integrity of Brazil’s electoral process.
