Brazil's TSE orders removal of disinformation targeting Lula

The Superior Electoral Court (TSE) in Brazil has issued several injunctions ordering the immediate removal of social media content that spreads disinformation regarding President Luiz Inácio Lula da Silva.

One major ruling by the court's plenary requires the removal of videos within 24 hours that falsely associate Lula with irregularities involving his son, Fábio Luís Lula da Silva, and alleged fraud within the National Institute of Social Security (INSS). The court majority diverged from initial reports that the content was protected political debate, ruling that imputing crimes without factual support is not protected by freedom of expression.

Additionally, Minister Estela Aranha ordered the removal of posts within three hours that falsely linked a pro-Lula demonstration on Avenida Paulista to a “satanic ritual.” The content used footage from a religious march for Exu held in August to misrepresent a political event from October.

Other judicial actions include the suspension of campaign materials from Flávio Bolsonaro that allegedly distorted Lula's statements to create false narratives, and orders to remove videos claiming Lula is linked to organized crime factions such as the PCC and Comando Vermelho.
