Argentina judicial conflict erupts over juvenile criminal law reform
A legal and political conflict has emerged in Argentina following the implementation of Law 27.801, which lowers the age of criminal responsibility from 16 to 14. In Buenos Aires province, Judge Marta Pascual issued a 60-day preventive suspension of the law, citing a lack of infrastructure and resources to house minors under 14. This decision has triggered three impeachment requests against her in the provincial Senate for alleged misconduct.
However, the judicial system is divided. Judge Mirta Guarino of the Moreno-General Rodríguez jurisdiction ruled that Pascual’s suspension is not legally binding in her district, ordering the continued application of the reform. Guarino argued that structural deficiencies in the state do not invalidate national laws.
While the reform faces challenges in Buenos Aires, other provinces are moving forward. Governor Osvaldo Jaldo confirmed that Tucumán is already applying the new law. In San Juan, Governor Marcelo Orrego noted that adapting the local judicial system to the national standard will require time and legislative transition.
The Asociación Judicial Bonaerense has issued a statement supporting Judge Pascual, defending judicial independence against what it describes as political pressure and campaigns of discredit.
