Buenos Aires Province regulates public land use on islands
The Government of the Province of Buenos Aires has implemented a new regulatory regime to manage the use and tenure of public domain properties located on the province's islands and Martín García Island. Through a new decree, the administration established the figure of the ‘Permiso de Uso y Tenencia Precaria’ (Precarious Use and Tenure Permit), which can be granted either free of charge or for a fee.
The measure aims to organize existing occupation situations and establish common criteria for the administration of these territories, which include the fluvial and maritime coastlines and the Bonaerense Delta. The Delta covers approximately 300,000 hectares across nine municipalities. The regulation clarifies that these properties remain part of the state's public domain and that permits do not constitute a transfer of state ownership.
A key component of the reform is the creation of the ‘Registro de Islas Bonaerenses de Dominio Público’ (Public Domain Bonaerense Islands Registry) within the Ministry of Government. This registry will centralize information regarding the use and tenure of these public properties, working in coordination with the Ministry of Economy's registry. This new system replaces previous decrees to simplify management and strengthen planning and control over these territories.
