Buenos Aires Province island land regulation

Overview

The Government of the Province of Buenos Aires has implemented a new regulatory regime to manage the use and tenure of public domain properties on its islands, including Martín García Island and the Bonaerense Delta.

Initially, the administration introduced the ‘Permiso de Uso y Tenencia Precaria’ (Precarious Use and Tenure Permit), which allows for either free or fee-based use of these territories. This measure was designed to organize existing occupations and establish common administrative criteria while ensuring that these properties remain part of the state's public domain. To facilitate this, the ‘Registro de Islas Bonaerenses de Dominio Público’ (Public Domain Bonaerense Islands Registry) was created to centralize information.

Following the implementation, the regime was further formalized through Decree No. 1.517/2026. This decree established a uniform legal framework covering property destination, conservation, and the restitution of assets. The updated regulation expands the scope of the previous 2020 registry to include islands outside the Delta and emphasizes environmental sustainability, specifically regarding the protection of wetlands and biodiversity.
