Chicago immigration enforcement shootings lead to federal lawsuits

Families and individuals involved in shootings by immigration agents during ‘Operation Midway Blitz’ in Chicago have filed legal actions against the federal government.

Marimar Martinez has filed a lawsuit alleging civil rights violations after being shot five times by a Border Patrol agent. The incident occurred after Martinez warned bystanders of an unmarked van she believed belonged to immigration agents. Martinez alleges she suffered physical trauma and emotional distress, further claiming she faced ‘malicious’ prosecution after being labeled a ‘domestic terrorist’ by Homeland Security officials. Her assault charges were later dropped following video evidence that contradicted the agent's account.

Separately, the estate of Silverio Villegas González, a 38-year-old Mexican father fatally shot by an ICE officer in Franklin Park, has filed a complaint under the Federal Tort Claims Act. The MacArthur Justice Center, representing the estate, alleges the killing was unjustifiable and contrary to Department of Homeland Security policy. Medical examiner findings indicated the officer shot Villegas downward into his neck at close range during a traffic stop. The legal team stated the claim is a formal step toward seeking accountability for the death.
