Lawsuits following Chicago immigration enforcement shootings

Overview

Legal actions have been initiated against the United States government following shootings involving immigration enforcement agents during ‘Operation Midway Blitz’ in Chicago.

Marimar Martinez, a U.S. citizen, filed a federal lawsuit alleging negligence, battery, and malicious prosecution after being shot by a Customs and Border Protection (CBP) agent. Martinez’s attorneys claim that agent Charles Exum provided false statements to the FBI regarding the trajectory of the shots. While federal prosecutors initially charged Martinez with assault, those charges were dismissed.

In a separate legal action, the estate of Silverio Villegas González, a Mexican national fatally shot by an ICE officer in Franklin Park, has filed a complaint under the Federal Tort Claims Act. The MacArthur Justice Center, representing the estate, alleges the shooting was unjustifiable and violated Department of Homeland Security policy. Medical examiner findings indicated the officer shot Villegas at close range during a traffic stop.
