A U.S. federal appeals court has issued a significant ruling in the legal battle over transgender healthcare for minors. The 9th U.S. Circuit Court of Appeals reinstated a Justice Department subpoena directed at QueerDoc, a telehealth provider. The court ruled 2-1 that a lower court judge erred in finding the subpoena was issued in bad faith to intimidate providers, stating that the President has the authority to align Department of Justice enforcement priorities with broader policy goals.

The subpoena seeks various records, including personnel files, billing data, and patient medical records, as part of an investigation into potential healthcare fraud and unlawful drug labeling regarding puberty blockers and hormones.

In a parallel regulatory move, the Centers for Medicare and Medicaid Services (CMS) finalized a rule prohibiting the use of federal Medicaid and CHIP funds to cover certain gender-affirming care services for minors. This follows executive orders from the Trump administration aimed at ending federal support for these treatments. Additionally, the Department of Health and Human Services released a report titled ‘Wolves in White Coats,’ which alleges that some medical providers pressured minors into gender transition treatments and highlights potential improper insurance billing practices.
