Associate Attorney General Stanley Woodward stated that the department will “vigorously enforce federal law, especially where the lives of children are endangered.” Expanding on these regulatory shifts, the Centers for Medicare and Medicaid Services (CMS) has issued a final rule prohibiting federal Medicaid and Children’s Health Insurance Program (CHIP) funds from covering certain gender-affirming care services for minors. This restriction affects individuals under 18 for Medicaid and under 19 for CHIP, limiting access to puberty blockers, hormone therapy, and surgeries. The CMS policy follows a Department of Health and Human Services (HHS) report titled ‘Wolves in White Coats: How Doctors and Hospitals Pushed and Profited from the Fraud of Gender Medicine’. The report alleges that some providers pressured minors into transition treatments and highlights potential improper insurance billing practices and financial incentives. Legal scrutiny of providers continues as the 9th U.S. Circuit Court of Appeals recently reinstated a DOJ subpoena directed at QueerDoc, a telehealth provider.
