Colombia Constitutional Court to rule on pension reform legality

The Constitutional Court of Colombia is scheduled to resume discussions regarding the legality of the pension reform, Law 2381 of 2024, on August 13. The court's review focuses on a technical procedural defect rather than the merits of the pension model itself. Specifically, judges must determine if the House of Representatives sufficiently corrected a previous error where the text was approved without adequate discussion.

The reform has been largely suspended since June 2025. The upcoming decision by the Sala Plena could either revive the law, strike it down, or mandate further legislative action. Due to changes in the court's composition and various recusals, substitute judge Carlos Pablo Márquez is expected to cast a tie-breaking vote. Magistrate Paola Meneses has already presented a draft decision for the court to consider.
