Colombia pension and public service reform

The Colombian government is navigating significant administrative and legal shifts regarding pensions and public service. The Constitutional Court is set to resume discussions on August 13 regarding the legality of pension reform Law 2381 of 2024. This review focuses on a technical procedural defect concerning whether the House of Representatives sufficiently corrected errors during the approval process, rather than the merits of the pension model itself.

Concurrently, the administration of President Abelardo De La Espriella is preparing a decree to mandate the retirement of public officials who have already met pension requirements. Vice President José Manuel Restrepo stated the initiative aims to promote generational turnover and create new professional opportunities without modifying or eliminating acquired pension rights. The proposal has faced opposition from labor unions and educational guilds concerned about job security.

Following these developments, the government addressed specific concerns regarding pensioned teachers working in official educational institutions. Vice President Restrepo issued a statement clarifying that there are no immediate measures to remove teachers who currently receive a pension while remaining employed.

The Ministry of National Education noted that the ability to receive both a salary and a pension depends on the specific legal regime governing each educator. Specifically, those under Decree 2277 of 1979 are permitted to continue working under established regulations, whereas teachers under Decree 1278 are subject to different rules regarding the compatibility of pensions and salaries, which remains a central point of debate.
