Colombian Council of State limits CNE's authority in Fonseca electoral dispute

On 9 July 2026 the first chamber of Colombia’s Council of State reviewed a petition that challenged the Administrative Tribunal of La Guajira’s protection of fundamental rights for Micher Pérez and others. The Council rejected the claim that the Constitutional Court could replace the ordinary judge in the electoral process, ruling that the tutela was an improper mechanism for the dispute. It affirmed that the National Electoral Council (CNE) must act in accordance with the constitutional principles of legality, due process, competence, motivation of administrative acts, and guarantees of contradiction and defense, and cannot bypass these requirements under the pretext of electoral transparency.

The decision does not resolve the substantive electoral controversy but clarifies the procedural limits of the CNE and reinforces the procedural safeguards that public authorities and citizens must observe in electoral matters.
