Consumer rights and trade-in strategies in the Dutch car market

Recent developments in the Dutch automotive market highlight the importance of consumer preparation and the legal weight of contract conditions. To maximize trade-in values, experts suggest that buyers should research market prices for comparable vehicles beforehand to establish an 'anchor' for negotiations. It is also recommended to treat the trade-in of an old vehicle and the purchase of a new one as two separate negotiations to prevent the dealer from offsetting a high trade-in offer with a higher sales price.

In a legal ruling from the Amersfoort Cantonal Court, a buyer was cleared of paying €1,845 in cancellation fees to a car dealership. The buyer had signed a contract for a €2,300 vehicle that included a suspensive condition: the purchase was contingent upon a technical inspection by the buyer's father and his subsequent approval. Because the inspection never took place, the court ruled that the conditions for the sale were never met, meaning no definitive purchase had occurred. Consequently, the dealer's claim for cancellation fees under BOVAG terms was rejected, and the dealer was ordered to reimburse the buyer's travel expenses.
