Consumer rights in the Dutch automotive market

Overview

In the Netherlands, consumer rights and negotiation strategies in the automotive market have been highlighted by legal developments and expert advice.

To optimize trade-in values, experts suggest that buyers research market prices for comparable vehicles to establish an ‘anchor’ for negotiations. They also recommend treating the trade-in of an old vehicle and the purchase of a new one as two separate negotiations to prevent dealers from offsetting high trade-in offers with higher sales prices.

A legal ruling from the Amersfoort Cantonal Court reinforced the importance of contract conditions. The court cleared a buyer of paying €1,845 in cancellation fees after a contract for a €2,300 vehicle included a suspensive condition: the purchase was contingent upon a technical inspection and subsequent approval. Because the inspection never occurred, the court ruled that the conditions for the sale were never met, meaning no definitive purchase had taken place. The dealer’s claim for fees was rejected, and the dealer was ordered to reimburse the buyer’s travel expenses.
