Contran approves new rules for alcohol and drug testing in traffic enforcement
The National Traffic Council (Contran) has approved new regulations for 'Lei Seca' (Dry Law) enforcement to enhance the detection of impaired drivers. The updated procedures include the use of specialized equipment to identify not only alcohol but also other psychoactive substances.
A key component of the new rules is the implementation of an initial screening process. Officers may use pre-test or passive breathalyzer equipment to detect signs of alcohol consumption. However, a positive result from this preliminary stage alone cannot be used to issue a fine or prove that a driver is under the influence.
The regulation also addresses protocols for drivers who refuse testing and cases involving residual alcohol in the mouth. Implementation of these new measures will follow the certification of the necessary devices and procedures. Traffic agencies have a 60-day window to adapt their systems and update enforcement codes following the official publication in the Union's Official Gazette.
