Brazil traffic regulation for drug and alcohol testing
Overview
The National Traffic Council (Contran) has established new regulations for ‘Lei Seca’ (Dry Law) enforcement in Brazil to improve the detection of impaired drivers.
Initial regulations focused on the use of a device known as a ‘drogômetro’, which uses saliva samples to identify psychoactive substances such as cocaine, marijuana, amphetamines, MDMA, heroin, LSD, fentanyl, and methamphetamine. The National Transit Secretariat (Senatran) clarified that while antidepressants and anxiolytics do not trigger the device unless they contain specific substances on the detection panel, driving aptitude remains a matter of medical evaluation.
Subsequent updates to the enforcement rules introduced a multi-stage screening process. Officers may now use pre-test or passive breathalyzer equipment for initial detection; however, a positive result from this preliminary stage is insufficient on its own to issue a fine or prove impairment. Following the official publication of these measures, traffic agencies have a 60-day window to adapt their systems and update enforcement codes.
