Costco Seeks Dismissal of Tariff Refund Class Action in Illinois

A proposed class action in a federal court in Illinois alleges that Costco Wholesale must pass on any future government tariff refunds to consumers who allegedly paid higher prices because of those tariffs. Plaintiffs argue that shoppers indirectly absorbed tariff costs and should share any reimbursements the retailer receives under the International Emergency Economic Powers Act.

Costco has moved to dismiss the suit, contending that customers voluntarily paid disclosed prices, suffered no legal injury, and that any future refunds are uncertain and not linked to past purchases.
