Overview

The February 2026 Supreme Court ruling that the International Emergency Economic Powers Act does not authorize the Trump‑era tariffs triggered a massive refund programme for the roughly $166 billion collected from importers. By late July more than $85 billion had been returned, adding about $120 billion to the federal deficit and widening it to $1.367 trillion for the first nine months of FY 2026. Treasury reported a net customs revenue of –$25.6 billion in June, the first month refunds outpaced collections.

Companies have pursued refunds through the courts. On 24 July Rivian Automotive sued for a full refund of the struck‑down duties, while firms such as Costco, FedEx, Toyota and Nintendo have also filed claims. The administration kept a temporary 10 % global tariff until 24 July 2026 and is preparing a permanent 12.5 % tariff on forced‑labour goods from 54 countries. The Justice Department continues to appeal limits on the $166 billion payout, and Treasury has been ordered to complete the remaining refunds within 80 days.

On 31 July Amazon disclosed that it had received roughly $600 million in tariff refunds and would automatically reimburse eligible U.S. and Mexican shoppers who paid higher prices because of the invalidated duties. The company said the remaining funds would be used to lower marketplace prices. Amazon’s announcement coincided with a 15 % jump in its stock and comes amid a class‑action lawsuit alleging the retailer over‑charged customers for tariff‑inflated prices.

The ongoing refund process continues to strain the federal budget while reshaping pricing strategies for major retailers and import‑dependent firms.
