The defense relies on a private accounting report from Specs Consultoria, which analyzed fund distributions from 'Fuente 14' between 2009 and 2015. According to the report, companies associated with businessman Lázaro Báez received approximately US$18.66 million, representing just 0.85% of the US$2.2 billion in budgeted roadwork funds. In contrast, the firm IECSA received US$360 million, accounting for 16.36% of the total examined funds.

Lawyers argue that this data contradicts the central premise of the original ruling, which claimed public resources were systematically directed toward Báez's business group. The defense maintains that the omission of this evidence in the initial trial demonstrates that the conviction was issued without sufficient proof and seeks a review of the sentence, which includes her disqualification from holding public office.
