Czech Government approves draft law on platform work

The Czech government has approved a draft law regarding platform work, aimed at regulating individuals working through digital platforms, such as couriers and drivers. The proposal introduces a rebuttable presumption of an employment relationship if the circumstances suggest the worker is performing dependent work.

Under this new framework, the burden of proof would shift to the platform or intermediary to demonstrate that an employment relationship does not exist. The proposal also addresses algorithmic management, requiring platforms to inform workers about automated systems used for monitoring, evaluation, task allocation, or determining pay and contractual status.

Key protections in the draft include the right to an explanation and human review for decisions made or supported by automated systems. Specifically, decisions regarding the termination of contracts or the restriction of user accounts must be made by a human. Additionally, workers would have the right to the portability of certain data, such as ratings and reviews, to be transferred to third parties upon request.
