The Czech Republic is undergoing legislative developments regarding labor law and employment classifications.

In early September, the Chamber of Deputies revisited a proposal to reform state employee regulations. The legislation seeks to transition state employees from a civil service relationship to a standard labor law relationship governed by the Labor Code. Proponents argue this will modernize administration and increase flexibility, while critics warn it could lead to the “politicization of the state administration” by making it easier to dismiss officials and reducing procedural protections.

By late September, the government approved new rules to clarify the definition of dependent work. These changes aim to distinguish between genuine self-employment and employment relationships disguised as entrepreneurial cooperation. The assessment will focus on factors such as work organization, control, and autonomy. Legal experts have expressed concerns that these changes may create uncertainty for established business models. Additionally, misclassifying workers to evade taxes or social security contributions could lead to criminal prosecution, with potential prison sentences for officials if evaded amounts exceed 100,000 CZK.
