Department of Education rescinds Title IX protections for LGBTQ+ students

The U.S. Department of Education has formally rescinded the 2024 Title IX regulations, which had expanded protections against sex discrimination to include sexual orientation and gender identity. In their place, the department has restored the 2020 regulations established during the first Trump administration under Betsy DeVos.

Education Secretary Linda McMahon stated the decision aims to protect the rights and athletic opportunities of women and girls, asserting that the move aligns with Congressional intent and court orders. The department also announced plans to launch increased investigations into schools that allow transgender athletes to compete in female sports categories.

Legal experts, including Dr. Pilar Margarita Hernández Escontrías of Seattle University School of Law, warned that the rescission places transgender and queer students at a higher risk of harm in educational settings. The department is also expected to pursue a forthcoming amendment that would define sex strictly by biological status at birth.
